Liability, Indemnity & Public Liability Policy

This policy explains the risk, liability and indemnity terms that apply when booking or participating in services with Mthunzi Tours and Safaris.

1. Public Liability Cover

Mthunzi Tours and Safaris is insured for public liability cover up to ZAR 2,000,000 per event, subject to the terms, conditions and exclusions of the applicable insurance policy.

2. Natural Risk

Safaris, wildlife viewing, transfers, tours, bush environments and outdoor activities may involve natural and travel-related risks.

These risks may include wildlife encounters, uneven roads, weather changes, heat, insects, illness, vehicle movement, road delays, remote locations and other circumstances beyond the control of Mthunzi Tours and Safaris.

3. Guest Participation

Guests participate in safaris, tours and transfers with the understanding that nature and travel involve risk.

Guests must follow all safety instructions, guide instructions, park rules and reserve rules.

Failure to follow instructions may result in injury, loss, removal from the activity or cancellation of the service without refund.

4. Indemnity Forms

Guests may be required to sign indemnity forms when entering South African National Parks, private game reserves, lodges, activity areas or third-party supplier premises.

Failure or refusal to sign required indemnity documents may result in the guest being unable to participate, with no refund due where the requirement was outside the control of Mthunzi Tours and Safaris.

5. Limitation of Liability

Mthunzi Tours and Safaris will not be liable for loss, injury, delay, missed flights, additional costs, damage or inconvenience caused by:

Incorrect information supplied by the client
Late arrival by the client
Guest misconduct or failure to follow instructions
Weather conditions
Road closures or traffic delays
Park or reserve rules
Third-party supplier actions or cancellations
Flight delays or airline changes
Medical conditions not disclosed before booking
Events beyond the reasonable control of Mthunzi Tours and Safaris

Nothing in this policy excludes liability where it cannot legally be excluded under applicable law.

6. Personal Belongings

Guests are responsible for their own personal belongings, including cameras, phones, wallets, bags, passports, travel documents, clothing and valuables.

Mthunzi Tours and Safaris is not responsible for lost, stolen, forgotten or damaged personal items unless caused directly by proven negligence.
